Featured in this lot is this Territory of Arizona vs. Frank C. Stilwell Cochise County arrest Warrant circa 1881; Provenance: From the Tombstone Western Heritage Museum in Tombstone, Arizona. This is an official handwritten Cochise County Recorder and stenographer transcriptions from the Stilwell examination which implicates Stilwell in the robbery and pertains to the allocation of expenses to the witnesses present in the trial. The document features the original signature of Judge Wells Spicer who eventually dropped the charges against Stilwell for insufficient evidence; these events and the re filing of Federal charges let to an increase in the animosity between the Earp party and The Cochise County Cowboys leading to the murder of Morgan Earp and the attempted murder of Virgil, which was stopped by Wyatt Earp with buckshot having confessed to the killing of Frank Stilwell later in Wyatts life. Frank C. Stilwell (1856 – March 20, 1882) was an outlaw Cowboy who killed at least two men in Cochise County during 1877–82. Both killings were considered to have been self-defense. For four months he was a deputy sheriff in Tombstone, Arizona Territory for Cochise County Sheriff Johnny Behan. Stilwell owned interests in several mines and various businesses, including a saloon, a wholesale liquor business, a stage line, and at his death livery stables in Charleston and Bisbee. He was also a partner in a Bisbee-area saloon with ex-Texas Ranger Pete Spence. The condition of this Cochise County arrest warrant is well preservd with some browning to the pages consistent with the age but otherwise shows a well preserved condition. The measurements of this two page document is 14" x 8 3/8". TTD299
