The lot features an original C.S. Fly Tombstone, Arizona Territory photograph cabinet card of George W. Swain in the circa 1880’s when he was the Tombstone City Attorney, also included is an original circa 1880’s George W. Swain business card and a circa 1906 handwritten letter to Swain. The image is an original cabinet card albumen photograph marked on the bottom, “Fly’s Gallery, Tombstone, A.T.” and on the back, “G.W. Swain ATTORNEY AT LAW, 115 4th Street, TOMBSTONE, A.T.”. The image is clearly of George Winchester Swain who served as the Judge, Justice of the Peace, City Attorney of Tombstone as well as being a silver miner there. The business card is also an original from the 1880’s and is marked, “VOTE FOR GEORGE W. SWAIN For City Recorder. ELECTION JANUARY 3rd.” This is the only known Fly photograph of the famous Judge and the only known business card / political card from Swain to exist in private or public collections. George W. Swain moved to Tombstone, Arizona in 1880 in a covered wagon from Julian, California. He initially worked in the silver mines of Tombstone but was soon after elected Justice of the Peace in 1883. He eventually became the City Attorney, County Attorney and then Judge of Tombstone. Swain was the Justice of the Peace presiding over the hanging of the five Bisbee holdup men were hanged, with Swain recalling them as being a cheerful quintet including Daniel Kelly, Omar W. Sample, James Howard, Daniel Dowd and William Delaney. Swain also recalled the day that the mob removed Heath from the jail, threw a rope around him and half carried, half dragged him to the telephone pole out of town where he was unceremoniously hanged (the photograph of which is offered in this sale). Among the notable trials that Judge George Winchester Swain presided over was the trial for the Shoutout at Wilson Ranch which ended in the last and most famous hanging in the history of Tombstone, Arizona. On April 7, 1899, two brothers, Thomas and William Halderman, shot and killed Constable Chester Ainsworth and his deputy Teddy Moore. The circumstances surrounding the shoutout and killings were very suspect. After the disputed trial the men were found guilty and hanged in November 1900, which was after two separate stays of execution; one by President William McKinley himself, and second by the Governor of Arizona Nathan Murphy. Constable Chester Ainsworth was the brother of the prosecutor at the trial, Attorney General Charles L. Ainsworth (the slain deputy, Teddy Moore, had threatened to kill one of the Halderman brothers earlier in a dispute over a woman the two were both attempting to court). C.S. Fly, Camillus “Buck” Sydney Fly (1849-1901) is one of the most noted photographers of the Old West, he and his wife Mary, also a photographer, moved to Tombstone in 1879 and established a photography studio there. Fly was an eyewitness of October 26, 1881, to the Gunfight at the O.K. Corral, which took place outside his photography studio. He was one of the earliest known photojournalists of the Old West and the only known photographer to take images of Native Americans while they were still at war with the U.S. He later served as Cochise County Sheriff from 1895 to 1897, Since most of his negatives were destroyed by fires, his photographs are highly prized. Also included is a handwritten letter from W.M. Hartenstein from Ventura, California on April 4th, 1906, to George W. Swain Tombstone, Arizona which notes the inclusion in the letter of the next three months “dues” and that further dues will be sent soon. What these dues are for is unknown. All three of the items are in plastic protection. The cabinet card measures 6.5-inches by 4.25-inches, business card is 3.5-inches by 2 1/8-inches and the letter is 7-inches by 5-inches.
