Featured in this lot is this rare Posse Comitatus document for Frank Stilwell circa 1881; Provenance: From the Tombstone Western Heritage Museum in Tombstone, Arizona. The document features a handwritten Posse Comitatus document from the County Recorder's office signed by Sheriff John Behan on the 5th of April, 1881. The document features the written oath to the Constitution from Stilwell and his signature at the bottom and features the signature of the County Recorder as witness. Stilwell was hired as an assistant deputy sheriff by Cochise County Sheriff Johnny Behan in April, 1881. Four months later, in August, Behan fired him for "accounting irregularities. Frank C. Stilwell (1856 – March 20, 1882) was an outlaw Cowboy who killed at least two men in Cochise County during 1877–82. Both killings were considered to have been self-defense. For four months he was a deputy sheriff in Tombstone, Arizona Territory for Cochise County Sheriff Johnny Behan. Stilwell owned interests in several mines and various businesses, including a saloon, a wholesale liquor business, a stage line, and at his death livery stables in Charleston and Bisbee. He was also a partner in a Bisbee-area saloon with ex-Texas Ranger Pete Spence. The condition of this Posse Comitatus document is well preserved with some browning to the page consistent with the age of the document but otherwise shows a well preserved condition.
